NOTICE OF TRUSTEE'S SALE NOTICE OF TRUSTEE'S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated February 22, 2005, executed by Borrowers, Andrea Dyer Fowler and Edward L. Fowler a/k/a Edward Lane Fowler, to Richard A. Pill or David D. Pill, the Trustee, of record in the office of the Clerk of the County Commission of Cabell County, West Virginia, in Book 1995, at Page 569. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 4014 Green Valley Road, Huntington, WV 25701. Pill & Pill, PLLC was appointed as Substitute Trustee by an APPOINTMENT OF SUCCESSOR TRUSTEE dated June 18, 2016, of record in the Clerk's Office in Book 386, at Page 703. The Borrowers defaulted under the Note and Deed of Trust and the Substitute Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustee will sell the following described property to the highest bidder at the front door of the Courthouse of Cabell County, in Huntington, West Virginia, on the following date: September 9, 2016 at 1:04 p.m. The property is described as of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Guyandotte District, Cabell County, West Virginia, and being more particularly described as follows: Situated in the State of WV, County of Cabell and in the District of Guyandotte. ALL that certain lot, piece or parcel of land situate in Guyandotte District, Cabell County, West Virginia, on the waters of Four Pole Creek, a tributary of the Ohio River, and is located on State Local Service Route 35 (Green Valley Road), and being more particularly described as follows: Beginning at a rebar (set) in the westerly right of way of said Green Valley Road, at the northeast corner of Misty Kleber (deed book 975 page 70); Thence leaving said Green Valley Road, and with said Kleber, North 42 degrees 02 minutes 20 seconds West, a distance of 169.09 feet to a pipe (found) in the easterly line of parcel B.; Thence leaving said Kleber, and with said parcel B, North 30 degrees 20 minutes 45 seconds East, a distance of 64.45 feet to a rebar (set); Thence North 74 degrees 27 minutes 09 seconds West, a distance of 86.30 feet to a rebar (set); Thence North 52 degrees 03 minutes 53 seconds West, a distance of 15.21 feet to a rebar (set); Thence North 42 degrees 02 minutes 20 seconds West, a distance of 37.23 feet to a rebar (set); Thence North 46 degrees 22 minutes 07 seconds East, a distance of 60.73 feet to a rebar (set); Thence South 49 degrees 33 minutes 44 seconds East, passing a rebar set at 285.37, a total distance of 297.55 feet to said westerly right of way of said Green Valley Road; Thence with said Green Valley Road, and with a non tangent curve to the right, having a radius of 383.73 feet, a central angle of 08 degrees 34 minutes 52 seconds, and an arc length of 57.47 feet; Thence South 46 degrees 42 minutes 54 seconds West, a distance of 42.53 feet to the BEGINNING, Containing 20,659.925 square feet or 0.474 acres, more or less, as shown on the plat of survey prepared by Danny A. Porter, Professional Land Surveyor, WV Registration Number 357. Subject, however to a 15 foot strip easement entirely across the land described above and extending from Green Valley Road through the land described above; the actual location of the easement is to be where the existing driveway is at this present time. And being a part of the same land conveyed unto Edward Lane and Andrea Dyer Fowler, Husband and Wife, by Theldia Blankinship, by deed dated the 28th day of March 2000, and is of record at deed book 1062 page 264 in the Office of Clerk of the County Court of Cabell County, West Virginia to which reference is hereby made. Parcel No: Map 11-70.2-6001 TERMS OF SALE: 1) The property will be conveyed in an "AS IS" physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk's office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
