TRUSTEE'S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated July 17, 2008, and duly recorded in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Document No. 291487, in Book No. 2235, at Page 477 and modified in Document No. 515127, in Book No. 377, at Page 591, Gary W. Lilly did convey unto Stephen L. Thompson, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated July 14, 2016 and recorded in the aforesaid Clerk's office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by MidFirst Bank to foreclose thereunder, will offer for sale at public auction at the front door of the Fourth Avenue Entrance of the Cabell County Courthouse in Huntington, West Virginia, on September 13, 2016 at 1:30 PM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Union District, Cabell County, West Virginia, and more particularly described as follows: PARCEL ONE (1): All those certain lots, pieces or parcels of land, situate in Union District, Cabell County, West Virginia, and known and designated upon a certain map of Savas Heights, a copy of which map is recorded in the office of the Clerk of the County Commission of Cabell County, West Virginia, in Map Book 9. at Map 86, as LOTS NOS. SEVENTEEN (17) AND TWENTYTHREE (23). PARCEL TWO (2): All that certain lot, piece or parcel of land, situate on the waters of Mud River, Union District, Cabell County. West Virginia, and being the southerly thirty-six feet of Lot #16 of Savas Manor, as shown on that certain plat of record in the office of the Clerk of the County Commission of Cabell County, West Virginia, in Map Book 9 at Page 86, and being more particularly bound and described as follows: BEGINNING at a 1-1 /2" galv. pipe (found) in the westerly right-of-way line of River Bend Drive. said pipe marking the easterly most corner common to Lots 16 and 17 of Savas Manor; thence leaving River Bend Drive and with the northerly line of Lot 17 North 78 23' 00" West a distance of 96.00 feet to a 1-1 /2" galv. pipe (found) marking the corner common to lots 16, 17, and 23; thence leaving Lot 17 and with the easterly line of Lot 23 North 24 05' 00" West a distance of 44.33 feet to a 5/8" rebar (set): thence leaving Lot 23 and severing Lot 16 South 78 23' 00" East a distance of 123 .10 feet to a rebar (set) in the westerly right of way line of River Bend Drive: thence with the westerly right of way line of River Bend Drive along the arc of a curve to the left a distance of 36.03 feet said curve having a radius of 526.00 feet, a chord distance of 36.02 feet and a chord direction of South 13 34' 14" West to the beginning containing 3,936.405 square feet or 0.090 acres as surveyed by Marvin R. Reynolds. Inc., Professional Surveyor. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 2671 Riverbend Drive, Ona, WV 25545- 9634. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk's Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in "AS IS" condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $9,000.00 in cash and/or certified funds as deposit with the balance due and payable within 30 days of the day of sale. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
