NOTICE NOTICE OF TRUSTEE SALE Pursuant to the authority vested by Deed of Trust dated the 25th day of January, 2012, Hurricane Plaza, Inc., Grantor, to P. Andrew Vallandingham and Samuel Vallandingham, Trustees, which said Deed of Trust is of record in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Trust Deed Book 2444, beginning at page 15, and the undersigned, Daniel T Yon and Melissa Eakle Leasure, substituted Trustees, by Substitution of Trustees of record in the office of the Clerk of the County Commission of Cabell County in Bonds, Contracts and Leases Book 389 at page 356 having been requested to do so by the Lender, and default having been made under the terms and conditions of said Deed of Trust, and the provisions of said Deed of Trust concerning acceleration having been complied with by the Lender and present holder of the note, said substituted Trustees shall sell at public auction on April 27, 2017 at 11:00 a.m. at the front steps of the courthouse of Cabell County, West Virginia, the following real more particularly described as follows: A tract of land situate in Barboursville District, Cabell County, East Side of Barboursville, West Virginia, on South Side of I-64 and North Side of U.S. Rte. 60, just East on mall Road, Tax Map 9, P/O Parcel 70.2, more particularly described as follows: BEGINNING, on a 3/4" pipe found, on a common corner to I-64 R/W and a N.W. corner to Chateau Grove, Inc. Tax Parcel 228, thence S. 30.01' 17" E. 210.95' with West line of Chateau Grove, Inc. to 1 1/4" pipe in concrete found. THENCE S. 09.06'54" E 77.71' with West line of Chateau Grove, Inc. to a division point, witness 22' North of edge of concrete pavement. THENCE S. 81.05'40" W. 130' with a division line 22' North of edge of concrete pavement, to a point. THENCE S. 75.52'54" W. 99.89 with a division line to a point in I-64 R/W. THENCE N. 06.33'28" E. 260' with I-64 R/W to a concrete R/W monument found. THENCE N. 59.37'44" E. 90.13' with I-64 R/W to the beginning. Containing 1.00 acre, more or less, as surveyed by Dallas Lovejoy. P.S. 193, Milton, West Virginia, and shown on a map titled, Plat Showing a 1.00 acre Lot for R.E.X., Inc., dated October 25, 1995, attached hereto and incorporated herein. Subject to R/W and easements. TERMS OF SALE: Ten percent (10%) of total bid amount cash in hand on day of sale. Remainder due within 30 days from date of Trustee Sale. Payment for unpaid real estate taxes to be assumed by the purchaser. Subject to any and all assessments and taxes against said property, and all prior liens and encumbrances of any nature whatsoever. The purchaser shall be responsible for the payment of the transfer taxes imposed by Article 2 of Chapter 11 of the West Virginia Code. Any sale hereunder may be adjourned from time to time without any notice other than the oral proclamation at the time and place appointed for this sale or by posting of a notice of same. Subject to the right of the Internal Revenue Service to redeem the property as provided by Section 7425 of the Internal Revenue Code, as amended.
