NOTICE NOTICE OF TRUSTEE SALE Pursuant to the authority vested by Deed of Trust dated the 8th day of July, 2016, Misty Short and Jacob Short, Grantors, to P. Andrew Vallandingham and Samuel Vallandingham, Trustees, which said Deed of Trust is of record in the Office of the Clerk of the County Commission of Wayne County, West Virginia, in Trust Deed Book 776, beginning at page 636, and the undersigned, Daniel T Yon and Melissa Eakle Leasure, substituted Trustees, by Substitution of Trustees of record in the office of the Clerk of the County Commission of Wayne County in Trust Deed Book 784 at page 80, having been requested to do so by the Lender, and default having been made under the terms and conditions of said Deed of Trust, and the provisions of said Deed of Trust concerning acceleration having been complied with by the Lender and present holder of the note, said substituted Trustees shall sell at public auction on April 13, 2017 at 10:00 a.m. at the front steps of the courthouse of Wayne County, West Virginia, the following real more particularly described as follows: TRACT NUMBER ONE (1): All that certain tract, piece or parcel of land situate on the waters of Beech Fork in Stonewall District, formerly Union District, Wayne County, West Virginia, and bounded and described as follows: BEGINNING at a sycamore on the bank of Beech Fork Creek, a corner to Parcel No. 2, and with same N. 45 W. 1000 feet to a stake in a branch; thence up said branch with its meanders N. 86 W. 165 feet , N. 67 W. 101 feet, N. 82 W. 122 feet, N. 48 W. 82 feet, S. 77 W. 79 feet N. 83 W. 82 feet, N. 67 W. 99 feet, N. 57 W. 115 feet, N. 81 W. 99 feet, S. 81 W. 86 feet, N. 76 W. 90 feet, S. 68 W. 65 feet to a stake in a branch in the line of Parcel No. 4, and with same S. 30 30' E. 2250 feet to a small elm on the bank of Beech Fork Creek; thence down same with center of channel S. 4 30' E. 250 feet to a stake a corner to Parcel No. 5; thence continuing down said creek S. 38 E. 115 feet, S. 85 E. 97 feet, N. 40 E. 120 feet, N. 5 E. 150 feet N. 40 30' E. 185 feet, N. 36 30' E. 300 feet, N. 40 E. 170 feet, N. 14 30' W. 186 feet; N. 27 E. 228 feet to the BEGINNING, containing 43.7 acres; RESERVING, however, a roadway 20 feet in width along the west side of the above described parcel for the use and benefit of Parcels Nos. 3 and 4, which roadway is shown upon the map attached to the Commissioner's report relating to said parcels. Together with the right to use certain roadway twenty (20) feet in width along the west side of Parcel No. 3 and along the east side of Parcel No. 6, for the purposes of ingress, egress, and regress to and from said parcel, which roadway is shown upon a map attached to the Commissioner's report. The party of the first part does further grant unto the party of the second part, or the survivor thereof, all of their right, title and interest in and to the reservation or right reserved to him in that certain gas lease to United Fuel Gas Company, conveyed to him in Deed recorded in the aforesaid Clerk's Office in Deed Book 594 at page 729. TERMS OF SALE: Ten percent (10%) of total bid amount cash in hand on day of sale. Remainder due within 30 days from date of Trustee Sale. Payment for unpaid real estate taxes to be assumed by the purchaser. Subject to any and all assessments and taxes against said property, and all prior liens and encumbrances of any nature whatsoever. The purchaser shall be responsible for the payment of the transfer taxes imposed by Article 2 of Chapter 11 of the West Virginia Code. Any sale hereunder may be adjourned from time to time without any notice other than the oral proclamation at the time and place appointed for this sale or by posting of a notice of same. Subject to the right of the Internal Revenue Service to redeem the property as provided by Section 7425 of the Internal Revenue Code, as amended. A ny sale may be conducted or adjourned by the designated agents or attorney of the Trustee. The undersigned is fully vested with the authority to sell said property as substituted Trustee.
