ORDER OF PUBLICATION IN THE CIRCUIT COURT OF CABELL COUNTY, WEST VIRGINIA Civil Action No. 15-C-828 Judge: Christopher D. Chiles PEOPLE'S COMMERCIAL FUNDING, LLC Plaintiff, V. KENNETH J. MCPHERSON ATALAYA ADMINISTRATIVE, LLC, and VISIO FINANCIAL SERVICES, INC. Defendants. The object of this suit is to foreclose on the real estate described as follows: TRACT NO. 1: All that certain lot, tract or parcel of land, situate in the City of Huntington, Cabell County, West Virginia, known and designated on a map of South Side Home Sites, which map is of record in the Office of the Clerk of the County Court of Cabell, West Virginia, in Deed Book No. 177, at Page 66, and known as LOT NUMBER THREE (3); TRACT NO. 2: PARCEL NO. 1: All that certain lot, piece or parcel of real estate situated in the City of Huntington, Cabell County, West Virginia, known and designated as Lot ''M'' of the Davis Sub-Division of the South half of Block Number Three Hundred Fifty-Four (354), as shown on a map of said Davis Sub-Division, filed February 13, 1917, and recorded in the Office of the clerk of the County Commission of Cabell County, West Virginia, in Deed Book No. 149, at Page 55, and also being particularly described as follows: BEGINNING at a point in the North line of Tenth Avenue, distant 309 feet easterly from the point of intersection of the North line of Tenth Avenue, with the East line of Thirteenth Street; thence in a northerly direction, parallel with said East line of Thirteenth Street, 200 feet to a point in the South line of the public alley; thence in an easterly direction along said South line of said public alley, and parallel with said North line of Tenth Avenue, 30 feet to a point; thence in a southerly direction, parallel with said Est line of Thirteenth Street, 200 feet to a point in said North line of Tenth Avenue, 30 feet to the place of BEGINNING; PARCEL NO. 2: All that certain piece or parcel of real estate situate in the City of Huntington, Cabell County, West Virginia, known and designated on a map of the Davis Sub-Division of the South One-Half of Block No. 354, made by Altman and Vickers, Engineers, recorded in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Deed Book No. 149, at Page 55, as Lot ''N'', the portion hereby conveyed being the westerly 15 x 200 feet of said Lot ''N''. It appearing by affidavit filed in this action that Plaintiff has used due diligence to ascertain the residence or whereabouts of the named Defendant, Kenneth J. McPherson, and it appears that said Defendant lives out of State; IT IS ORDERED that Kenneth J. McPherson serve upon Paul J. Prunty, plaintiff's attorney, whose address is 430 Sixth Avenue, Huntington, West Virginia 25701, an Answer including any related counterclaim, or other defense to the Complaint filed in this action on or before the 26th day of September, 2016, otherwise judgment by default will be taken against him at any time thereafter.
