NOTICE OF TRUSTEE'S SALE NOTICE OF TRUSTEE'S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated August 2, 2001, executed by the Borrowers, Herman Clark aka Herman G. Clark and Sarah E. Porter-Clark, to Mitchell Lee Klein, the Trustee, of record in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Book 1692, at Page 87. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 140 North High Street, Huntington, WV 25702. Pill & Pill, PLLC was appointed as Substitute Trustee by an APPOINTMENT OF SUCCESSOR TRUSTEE dated March 13, 2015, of record in the Clerk's Office in Book 389, at Page 325. The Borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Cabell County, in Huntington, West Virginia, on the following date: April 26, 2017 at 12:28 p.m. All that certain lot, tract, piece, or parcel of lands situate in the City of Huntington, Gideon District, Cabell County, West Virginia, in what was formerly the Town of Guyandotte, and now a part of the City of Huntington, and in the Southland Addition to said Town, and known and designated on a certain map of the "Southland Addition", made by W. G. Wilkins Company, Engineers, a copy of which map was filed in the Office of the Clerk of the County Court of Cabell County, West Virginia, on the 20th day of August, 1915, and bounded and described as follows, to-wit: BEGINNING at an iron pin in the easterly line of North High Street; thence from said Beginning point South 54 East, one hundred and fifty-six (156) feet to an iron pin in the west side of a fifteen foot alley; thence along and with the west line of said alley North 20 East, a distance of twenty-six (26) feet to a point; thence North 41 45' East a distance of ten (10) feet to a point; thence leaving said alley line North 54 West, one hundred fifty (150) feet to an iron pipe in the east line of said North High Street; thence along and with the east line of said North High Street; South 41 45' West, twenty-five (25) feet to a point; and, thence South 20 West, a distance of twelve (12) feet to the point of beginning, and being a part of Lots 10 and 11, in Block "K", of said Southland Addition, as shown on said map. Being the same property conveyed to Herman G. Clark by the Deed dated August 2, 2001 and recorded in Deed Book 1082, at Page 416. in the Office of the Clerk of the County Commission of Cabell County, West Virginia. TERMS OF SALE: 1) The property will be conveyed in an "AS IS" physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk's office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
