Salmons, Jr. did convey unto Richard A. Pill, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated March 23, 2017, and recorded in the aforesaid Clerk's office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by FEDERAL NATIONAL MORTGAGE ASSOCIATION to foreclose thereunder, will offer for sale at public auction at the front door of the Fourth Avenue Entrance of the Cabell County Courthouse in Huntington, West Virginia, on May 2, 2017 at 1:30 PM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in McComas District, Cabell County, West Virginia, and more particularly described as follows: All that certain piece or parcel of land situate on the water of Guyandotte River, in McComas District, Cabell County, near Salt Rock, West Virginia and being more particularly bounded and described as follows: BEGINNING at a point in the westerly right of way line of Secondary Route 58 (River Road), said point being S. 58 52 E. 5.00 feet from a 1 1/2 inch pipe (set), said point also being S. 2 31 50" W, 1899.50 feet from an 18 inch wild cherry tree at the northeast corner of the lands of James L. McDonald and Mildred E. McDonald (DB 765 Page 777), from which this parcel is being severed, said cherry also being a common corner to the lands of Charles and Billie R. Brown (DB 827 at Page 182 and in the southerly line of Robert & Kathleen Frye DB 566 at P 427 ); thence from said BEGINNING point and with the said right of way line, S. 34 08 40" W. 225.26 feet to a point in said right of way, said point being S. 55 51 E. 5.00 feet from a 1 1/2 inch pipe set in the said right of way line; thence continuing with said line, S. 62 00 W. 67.42 feet to a 1 1/2 inch pipe (set); thence leaving said right of way line and severing the land of James L. and Mildred E. McDonald (DB 765 at P 777), N. 58 52 W. 54.40 feet to a 1 1/2 inch pipe (set); thence N. 31 08 E. 413.64 feet to a 1 1/2 inch pipe (set); thence S. 58 52 E. passing at 145.00 feet to a 1 1/2 inch pipe set, in all 150.00 feet to the PLACE OF BEGINNING. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 4975 Guyan River Road, Salt Rock, WV 25559. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk's Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in "AS IS" condition.
