TRUSTEE'S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated May 17, 2006, and duly recorded in the Office of the Clerk of the County Commission of Wayne County, West Virginia, in Document No. 312962 239, in Book No. 633, at Page 952, Bryan L. Byard and Sarah A. Byard did convey unto Richard A. Pill, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated April 7, 2017, and recorded in the aforesaid Clerk's office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by FEDERAL NATIONAL MORTGAGE ASSOCIATION to foreclose thereunder, will offer for sale at public auction at the front door of the Wayne County Courthouse in Wayne, West Virginia, on May 23, 2017 at 2:45 PM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Ceredo District, Wayne County, West Virginia, and more particularly described as follows: PARCEL ONE: All that certain piece or parcel of land situate south of the City of Kenova, Wayne County, West Virginia, being the southeast portion of Lot Number 31, shown and designated upon a map entitled, "OAKVIEW HEIGHTS, KENOVA, WAYNE CO., WEST VA., APRIL 8, 1946, G. RIFE", now of record in the office of the Clerk of the County Court of Wayne County, West Virginia, in Map Book No. 3, at Page No. 78, as THE WESTERLY PORTION OF LOT NO. THIRTY-FIVE (35), being more particularly bounded and described as follows: Beginning at the southwesterly corner of Lot No. 34 which point is located in the northerly boundary of Oakview Drive near the intersection with 15th Street Road; thence N. 66 15' E 375.54 feet to a point in the southerly boundary of 15th Street Road; thence continuing with said boundary of 15th Street Road on a curve having a radius of 60 feet in an easterly direction 57.27 feet to a point; thence S 7 37' W 435 feet to a point in the northerly boundary of Oakview Drive; thence with the said northerly boundary of Oakview Drive on a curve having a radius of 45 feet in a northwesterly direction 49.70 feet, more or less; thence N 20 12' W 38.22 feet; thence continuing along the northerly boundary of Oakview Drive on a curve having a radius of 215 feet in a westerly direction 63.42 feet; thence N 37 06' W 92.22 feet; thence continuing along said Oakview Drive on a curve having a radius of 115 feet in a westerly direction 68.88 feet; thence N 71 25' W 151.80 feet to the point of beginning. BT-35751 At the time of the execution of the Deed of Trust, this property was reported to have an address of: 1300 Oakview Heights, Kenova, WV 25530. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk's Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in "AS IS" condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
