NOTICE OF SUCCESSOR TRUSTEE'S SALE Notice is hereby given, by virtue of the authority vested in the undersigned Successor Trustees, James W. Lane, Jr. and Bradford P. Bury, by that certain Deed of Trust made by Christopher J. Riffe, dated November 30, 2006 and recorded December 15, 2006 in the office of the Clerk of the County Commission of Cabell County, West Virginia in Trust Deed Book 2127 at page 372, the said Successor Trustees acting by virtue of that certain Appointment of Successor Trustee dated July 26, 2016 and recorded August 15, 2016 in the aforesaid Clerk's office in BCL Book 387, at page 356, and default having been made in the payment of the Note secured by the aforesaid Deed of Trust, and having been requested in writing by the owner and holder of the Note, will offer for sale, at public auction, to the highest bidder at the front door of the Courthouse of Cabell County, West Virginia, on September 26, 2016 at 9:00 a.m. all that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, described as follows: All that certain lot or parcel of land, together with any improvements thereon and the appurtenances thereunto belonging, situate on the waters of Mill Creek, Grant District, Cabell County, West Virginia, more particularly bounded and described as follows, to-wit: BEGINNING at a stone on the West Bank of Mill Creek, and running with the creek N. 42 E. 113 feet, thence N. 30 35' E. 123 feet; thence N. 32 45' E. 261 feet; thence N. 82 E. 38 feet; thence S. 79 30' E. 78 feet; thence N. 60 30' E. 70 feet; thence N. 19 15' E. 270 feet; thence N. 38 15' W. 68 feet; thence N. 74 45' W. 60 feet; thence N. 27 W. 68 feet; thence N. 1 50' W. 80 feet; thence N. 11 45' W. 193 feet; thence N. 56 45' 195 feet; thence S. 14 W. 83 feet; thence S. 8 W. 97.5 feet to a Chestnut Oak; thence S. 7 W. 107 feet to a Gum; thence 24 30' W. 60 feet to a Black Oak; thence S. 44 30' W. 97 feet to a stone; thence N. 9 20' E. 485 feet to a stone set in the ground in the North line of Lower Creek Road; thence with the North line of said road to the place of BEGINNING, containing five (5) acres, more or less. AND BEING the same property conveyed unto Christopher J. Riffe, unmarried, from Mitchell Lee Klein, as special commissioner, by deed dated December 31, 1998, of record in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Deed Book 1042, at page 474. At the time of execution of the deed of trust, the grantor represented that the address of the property was 1792 Newmans branch Road, Milton, WV 25541. TERMS OF SALE: The Premises will be sold "AS IS, WHERE IS," in its present condition and with all faults and defects, if any. The Premises will be conveyed by deed with no covenants of warranty of title. The Premises shall be sold subject to all liens not discharged by the sale, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges and liens with priority to the Deed of Trust pursuant to which this sale is being conducted. The Premises shall be sold subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk's office or visible upon the ground. The Premises will be sold for cash in hand on the date of sale to the highest bidder. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamps to be affixed to the deed). The Successor Trustees and City National Bank of West Virginia shall not be responsible for the removal of any person or personal property from the Premises. Pursuant to the Deed of Trust, the Successor Trustees may postpone the sale by public announcement at the time and place designated and act by agent in the execution of the sale.
