NOTICE OF TRUSTEE SALE OF VALUABLE REAL ESTATE Pursuant to the authority vested in the undersigned by deed of trust dated the 24th day of July 1997, signed by Garland J. Plymale, Sr. and Donna K. Plymale, married, to William D. Levine and J.W. St. Clair, Trustees, which said deed of trust is of record in the Office of the Clerk of the County Commission of Wayne County, West Virginia, in Trust Deed Book 470, at page 903, said deed of trust having been re-recorded in Trust Deed Book 473 at page 141, and Golden & Amos, PLLC, Trustee having been requested so to do by the Secured Creditor, and default having been made under the terms and conditions of said deed of trust, and the provisions in said deed of trust concerning acceleration having been complied with by the Secured Creditor and present holder of the note, said Trustee will sell at public auction at 8:00 o'clock A.M. on the 22nd day of JUNE 2017 at the front doors of the Courthouse in Wayne County in Wayne, West Virginia the following described real estate: All that certain lot or parcel of real estate situate on the waters of Garrett's Creek, Union District, Wayne County, West Virginia, and being more particularly described as follows: Beginning at an iron pin (set) in the southerly line of Local Service Route 52/9 (Garrett's Creek Road), corner to Tract Six, thence, leaving said right of way and with Tract Six, severing the lands of Aily Perry (DB 316, PG 293), S. 60 degrees 46' East 120.17 feet to an iron pin (set) north bank of Garrett's Creek, corner to Tract Five; thence, leaving Tract Six and with Tract Five up the Creek, S. 7 degrees 11' W. 131.11 feet to a 12 inch elm, common corner to Tract One, Calvin Damron, Jr., Et us (DB 464, PG 369) thence leaving Tract Five and with said Damron S. 83 degrees 19' W. 156.76 feet to an iron pin (set), N. 1 degrees 07' W. 119.30 feet to an iron pin (set) in the southerly line of said Route 52/9; thence leaving said Damron and with said right of way, N. 38 degrees 23' E. 111.99 feet to the beginning, containing SIXTY FIVE ONE HUNDRETHS (0.65) ACRE, more or less, as surveyed by Randy B. Fry, L.S., on January 28, 1980. It is the intention of this notice to sell the secured property by proper description as was intended to be transferred and conveyed in the aforesaid deed of trust. The above described real estate is reported to have a mailing address of: 3419 Garrets Creek Rd., Wayne, West Virginia 25570 TERMS OF SALE: Cash in hand on day of sale or within 30 days of date of sale upon terms to be agreed upon between Trustee and successful bidder, time being of the essence; payment for unpaid real estate taxes to be assumed by the purchaser. The Trustee does not warrant title or fitness to this property; it is being purchased as is; this is a buyer beware sale and any buyer is advised to retain counsel before the sale. If there is any part of the process of sale which is found to be objectionable, the Trustee reserves the right to cancel the sale. No purchaser should take possession or make improvements in the premises until the Trustee deed is delivered or recorded.
