NOTICE OF TRUSTEE'S SALE NOTICE OF TRUSTEE'S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated November 14, 2006, executed by the Borrowers, Jeffrey M. Ferrell and Melinda D. Ferrell, to Charles D. Dunbar or David Allan Barnette, the Trustees, of record in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Book 2125, at Page 280. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 6429 Little 7 Mile Road, Huntington, WV 25702. Pill & Pill, PLLC was appointed as Substitute Trustee by an APPOINTMENT OF SUCCESSOR TRUSTEE dated March 3, 2017, of record in the Clerk's Office in Book 389, at Page 605. The Borrowers defaulted under the Note and Deed of Trust and the Substitute Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustee will sell the following described property to the highest bidder at the front door of the Courthouse of Cabell County, in Huntington, West Virginia, on the following date: July 18, 2017 at 11:30 a.m. The property is described as of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Barboursville District, Cabell County, West Virginia, and being more particularly described as follows: SITUATE IN BARBOURSVILLE DISTRICT, CABELL COUNTY, WEST VIRGINIA, AND BEING MORE PARTICULARLY BOUNDED AND DESCRIBED AS FOLLOWS: BEGINNING AT A POINT IN THE WESTERLY RIGHT-OF-WAY LINE OF LITTLE SEVEN MILE ROAD (S.R. 19) AT THE SOUTHEASTERLY CORNER OR GROVER M. & ERNESTINE FERRELL (D.B. 749 PG. 585) FROM WHICH AN IRON PIPE (FOUND) BEARS NORTH 78 DEG. 41' 00" WEST, 1.83 FEET, THENCE LEAVING SAID GROVER & ERNESTINE FERRELL, WITH SAID ROAD, CURVING TO THE LEFT 133.68 FEET HAVING A RADIUS OF 870.00 FEET, AND A CHORD OF WHICH BEARS SOUTH 10 DEG. 21' 55" WEST, 133.55 FEET TO A POINT, THENCE, LEAVING SAID ROAD, SEVERING THE GRANTOR HEREIN, NORTH 77 DEG. 04' 15" WEST, PASSING A 3/4" IRON PIN AND CAP (SET) AT 5.59 FEET IN ALL 190.78 FEET TO A 3/4" IRON FORM PIN, THENCE NORTH 04 DEG. 54' 17" EAST, 128.97 FEET TO A 3/4" IRON FORM PIN ON THE SOUTHERLY LINE OF THE AFOREMENTIONED GROVER & ERNESTINE FERRELL, FROM WHICH A 2" IRON PIPE (FOUND) BEARS NORTHS 78 DEG. 41' 00" WEST 140.86 FEET, THENCE WITH SAID FERRELL, SOUTH 78 DEG. 41' 00" EAST, PASSING AN AFOREMENTIONED 2" PIPE AT 201.06 FEET, IN ALL 202.89 FEET TO THE BEGINNING, CONTAINING 0.59 ACRES, MORE OR LESS, AND SUBJECT TO ALL LEGAL EASEMENTS AND RIGHT-OF-WAYS. Being the same property conveyed to Jeffrey M. Ferrell and Melinda D. Ferrell by the Deed dated March 23, 2001 and recorded in Deed Book 1077, at Page 339, in the Office of the Clerk of the County Commission of Cabell County, West Virginia. TERMS OF SALE: 1) The property will be conveyed in an "AS IS" physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk's office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
