NOTICE OF TRUSTEE'S SALE Notice is hereby given that default has occurred in the payment of that certain indebtedness secured by a Deed of Trust executed February 28, 2012, of record in the Office of the Clerk of the County Commission of Logan County, West Virginia, in Trust Deed Book 592, at page 111 (the "Deed of Trust"), made by John D. Justice ("Grantors"), to Casie McGee, in her capacity as Trustee (the "Original Trustee"), predecessor in interest to Ian G. Henry (the "Substitute Trustee" or "Trustee"), in favor of Vanderbilt Mortgage and Finance, Inc., (the "Beneficiary"), to secure the payment of a note in the amount of $109,013.62. The Substitute Trustee was appointed in the Original Trustee's place and stead, by instrument recorded in the aforesaid Clerk's office in Trust Deed Book 637, at page 137-139. EXHIBIT A Situate on the Right Fork of Buffalo Creek near Amherstdale in the Triadelphia District of Logan County, West Virginia, and being more particularly described as follows: Beginning at a 5/8 inch capped rebar set on the front common corner of Lots 4-A and 3-A and on the State Road 16/1 right of way limits; Thence, along said right of way, downstream, N 45 25' W 120.02 feet to a surveyed point Thence, continuing N 45 32' W 161.30 feet to a point of curve; Thence, along the arc of a curve to the left with a radius of 875.00 feet for a distance of 101.92 feel to a 5/8 inch capped rebar set at APCO utility pole #856C127; Thence, leaving said right of way and running up the Right Fork of Buffalo Creek along the southern bank thereof, S 56 09' E 268.50 feet to a point; Thence, continuing S 60 54' E 69.72 feet to a point; Thence, continuing S 49 55' E 52.88 feet to a 5/8 inch capped rebar, common corner to Lot 3-A; Thence, running with Lot 3-A, S 45 39' W 61.80 feet to the Place of Beginning, containing 1/4 acre more or less. Being a part of the same property conveyed unto Charles E Frye and Sandra K Frye, by deed dated November 3, 1997, recorded Logan County Deed Book 525, at Page 483. And, deed dated April 18, 1994, recorded Logan County, Deed Book 502, at page 196, Said Charles E Frye, deceased 03/2011, by right of survivorship, Sandra K Frye, is sole owner. TERMS OF SALE: Sale of the Real Estate will be made by the Trustee by public auction to the highest bidder. The Trustee reserves the right to reject any bid that in opinion is inadequate. The highest bidder will be required to tender the purchase price in cash or immediately available funds by the end of the day of sale. The Trustee reserves the right to accept or reject such other terms as to payment or delivery of payment as may be made be agreed to by the Trustee and the bidder in advance of the sale. The Beneficiary of the Deed of Trust does not make any representations or warranties as to the physical condition of the Real Estate. Risk of loss or damage will be the purchaser's from and after the foreclosure sale. All outstanding taxes, assessments and utility charges will be the responsibility of the purchaser. If Trustee cannot convey insurable or marketable title, purchaser's sole remedy is the return of the purchase money paid by the purchaser for the purchase of the Real Estate.
