West Virginia Department of Environmental Protection Public Information Office 601 57th Street SE Charleston, WV 25304 304-926-0440 PUBLIC NOTICE OF UNIFORM ENVIRONMENTAL COVENANT ACT SITE CLEANUP METHOD PUBLIC NOTICE NO.: UECA #00-043 PAPER: The Herald-Dispatch PUBLIC NOTICE DATE: July 13, 2017 The Office of Environmental Remediation (OER) at the West Virginia Department of Environmental Protection has approved a cleanup method to address environmental conditions at Exxon One Stop #516 under the Uniform Environmental Covenant Act (UECA). The applicant, ExxonMobil Corporation, has been working with the WVDEP since negotiating a UECA Agreement on September 8, 2011. The site is located at 1413 Route 60 East, Huntington, Cabell County, West Virginia, and is comprised of approximately 0.586 acres of property. The Site has operated as an active automotive service station since the late 1940's. Environmental investigations at the Site between 1998 and 2013 have documented that both groundwater and soil gas at the Site were impacted by activities associated with the operation of a retail gasoline service station. Chemicals of Concern (COC) were determined by screening maximum concentrations in groundwater and soil gas against conservative benchmarks developed to be protective of human health for direct contact exposure, potential migration to groundwater, and potential migration to indoor air. Constituents exceeding the screening criteria were selected as COCs, and evaluated further in the risk assessment. COCs in groundwater included benzene, methyl tert-butyl ether (MTBE), and naphthalene. COCs in soil gas included benzene and acrolein. A conceptual site model was developed for the Site using residential and non-residential exposure assumptions. Potential receptors evaluated in the risk assessment included hypothetical future on-site residents, current and hypothetical future on-site workers, and current and hypothetical future on-site and off-site construction workers. Based on a comparison to available data, three on-site exposure pathways were carried forward in the quantitative risk assessment: on-site resident (exposure to inhalation of volatiles migrating into indoor air from soil gas), on-site commercial workers (exposure to inhalation of volatiles migrating into indoor air from soil gas), and on-site construction workers (exposure to groundwater from direct contact). One off-site exposure pathway was carried forward in the quantitative risk assessment: off-site construction workers (exposure to groundwater from direct contact). The risk assessment concluded that exposure to COCs in groundwater and indoor air by the on-site and off-site receptors was within the acceptable risk and hazard targets promulgated in applicable regulatory guidance. However, the exposure to groundwater used as a potable water source was identified as an elevated risk that warrants a restriction which prohibits the extraction of groundwater for any use except groundwater monitoring and/or remediation. A land use covenant restricting the extraction of groundwater for any use except groundwater monitoring and/or remediation was recorded with the Office of the Cabell County Clerk on May 3, 2017, and is located in Deed Book 389 page 680.
