NOTICE OF FINDING OF NO SIGNFICANT IMPACT AND NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS Date of Publication: 7/20/2017 Mingo County Commission 75 East 2nd Avenue, Room 308 Williamson, WV 25661 (304) 235-0378 These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the Mingo County Commission. REQUEST FOR RELEASE OF FUNDS On or after August 7, 2017 the Mingo County Commission will submit a request to the West Virginia Development Office for the release of Community Development Block Grant funds under Title 1 of the Housing and Community Development Act of 1974 (PL 93-383), to undertake the following project: Project Title: Beech Creek Water Main Extension Project Purpose: The proposed Beech Creek Water Main Extension Project will provide potable water and fire protection service to approximately 252 residences in the Beech Creek area of Mingo County, WV. Currently, many residents within the project area report that their well water is unfit to drink, has a bad odor and stains clothing. The waterline extension will be supplied by the Mingo County Public Service District's (PSD) Naugatuck Water Treatment Plant. Location: Beech Creek area (Magnolia Magisterial District) of Mingo County, WV Estimated Cost: Total Project $4,798,000; HUD Funding $1,500,000 FINDING OF NO SIGNIFICANT IMPACT The Mingo County Commission has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the Mingo County Commission at 75 East 2nd Avenue, Room 308, Williamson, WV 25661 and may be examined or copied weekdays 9:00 A.M to 4:00 P.M. PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the ERR to the Mingo County Commission. All comments received by August 7, 2017 will be considered by the Mingo County Commission prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing. RELEASE OF FUNDS The Mingo County Commission certifies to the State of West Virginia that Diann Hannah in her capacity as President, Mingo County Commission consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The State of West Virginia's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the Mingo County Commission to use HUD program funds. OBJECTIONS TO RELEASE OF FUNDS The State of West Virginia will accept objections to its release of fund and the Mingo County Commission's certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the Mingo County Commission; (b) the Mingo County Commission has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by the State of West Virginia; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to the West Virginia Development Office at 1900 Kanawha Boulevard East, Building 3, Suite 700, Charleston, WV 25305.
