NOTICE OF TRUSTEE SALE OF VALUABLE REAL ESTATE Pursuant to the authority vested in the undersigned by Deed of Trust dated the 14th day of March, 2012, signed by Lucille E. Jordan, to Robert L. Milam and Carl Adkins either or whom may act, Trustees, which said Deed of Trust is of record in the Office of the Clerk of the County Commission of Boone County, West Virginia, in Trust Deed Book 332, at Page 724, and Stephanie L. Abraham, acting as Substitute Trustee, by virtue of the Appointment of Substitute Trustee dated July 10, 2017, having been recorded in the aforesaid Clerk's Office, said Trustee having been requested so to do by the Secured Creditor, and default having been made under the terms and conditions of said Deed of Trust, and the provisions in said deed of trust concerning acceleration having been complied with by the Secured Creditor and present holder of the note, said Trustee will sell at public auction at 9:30 o'clock a.m. on the 16th day of August, 2017, at the front doors of the Courthouse in Boone County, in Madison, West Virginia, the following described real estate: All that certain lot or parcel of real estate situate, lying and being near the mouth of Brush Creek, in Peytona District, Boone County, West Virginia, described as follows: BEGINNING at an iron pipe at the edge of the public road opposite the Big Star Super Market, said pipe being 16 feet from the center of the railroad crossing; thence with the edge of said road in the direction of away from Big Coal River, a distance of 50 feet to a point on the edge of said road; thence to the left at a right angle a straight line a distance of 41-1/2 feet to a point; thence to the right at a right angle a straight line a distance of 37-1/2 feet to a point; thence to the left at a right angle a straight line a distance of 28 feet to a point; thence to the right at a right angle a straight line a distance of 39 feet, more or less, to a point on the edge of said road; thence to the left with the edge of said road and with the line of Cora Bradley a distance of 120 feet to an iron pipe on the edge of the State Road; thence to the left and with the edge of said State Road a straight line a distance of 278 feet to an iron pipe at the edge of said State Road, a corner to Cecil Nelson; thence to the left with the line of Cecil Nelson a distance of 195 feet to an iron pipe a corner of said Cecil Nelson land; thence to the left a straight line a distance of 409 feet to the place of beginning, containing 1 1/4 acres, more or less. To said parties of the first part do not hereby warrant title to the minerals and mineral rights, in, to and underlying the land hereby conveyed. It is understood and agreed by and between the parties hereto that there is excepted and reserved from the operation of this conveyance all right, title and interest in the land hereby conveyed which may be now held by the Chesapeake & Ohio Railway Company, a corporation. And being the same property conveyed to John E. Jordan and Lucille Jordan, husband and wife, as joint tenants with the right of survivorship, by a deed dated March 29, 1976, from Herbert Jordan and Betty Jordan, husband and wife, said deed is of record in the Office of the Clerk of the County Commission of Boone County, West Virginia, in deed Book 146, at Page 712. John E. Jordan died on June 20, 2010, vesting title of the hereinabove described property to his wife, Lucille Jordan, pursuant to the survivorship provisions in the aforementioned deed. It is the intention of this notice to sell the secured property by proper description as was intended to be transferred and conveyed in the aforesaid Deed of Trust. The above described real estate is reported to have a mailing address of: 687 Costa Road, Costa, WV 25051 TERMS OF SALE: Cash in hand on day of sale or within 30 days of date of sale upon terms to be agreed upon between Trustee and successful bidder, time being of the essence; payment for unpaid real estate taxes to be assumed by the purchaser. The Trustee does not warrant title or fitness to this property; it is being purchased as is; this is a buyer beware sale and any buyer is advised to retain counsel before the sale. If there is any part of the process of sale which is found to be objectionable, the Trustee reserves the right to cancel the sale. No purchaser should take possession or make improvements in the premises until the Trustee deed is delivered or recorded. A third party purchaser at sale will be required to pay the purchase price plus all recording and transfer fees. Trustee at sale is under no duty to cause any existing tenant or person occupying the subject property to vacate said property. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. The party(ies) secured by the Deed of Trust reserved the right to purchase the property at such sale. If the purchaser at sale is unable to complete the terms of purchase within 30 days, the Trustee reserves the right to transfer the property the next highest bidder. Any sale hereunder may be adjourned from time to time without any notice other than oral proclamation at the time and place appointed for this sale or by posting of a notice of same. Should the Trustee not appear at the time appointed for the sale and there is no notice posted of a continuance please contact the office of the Trustee to make further inquiry. Any sale may be conducted or adjourned by the designated agent or attorney of the Trustee. The undersigned is fully vested with the authority to sell said property as Trustee by instrument of record.
