TRUSTEE'S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated October 9, 2015, and duly recorded in the Office of the Clerk of the County Commission of Wayne County, West Virginia, in Document No. 3130491184, in Book No. 768, at Page 376, Amy L. Brumfield and Richard L. Brumfield did convey unto Douglas B. Ernest and Charles J. Mildren, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated July 24, 2017, and recorded in the aforesaid Clerk's office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Franklin American Mortgage Company to foreclose thereunder, will offer for sale at public auction at the front door of the Wayne County Courthouse in Wayne, West Virginia, on August 29, 2017 at 2:45 PM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Ceredo District, Wayne County, West Virginia, and more particularly described as follows: PARCEL NO. 1: All that certain piece or parcel of real estate situate near the mouth of Buffalo Creek, Ceredo District, Wayne County, West Virginia, known and designated upon a certain map or plat entitled "Map of Valley View, Route 1, Kenova, W. Va., J. W. Alley, Surveyor", and which said map is now of record in the Office of the Clerk of the County Court of Wayne County, West Virginia, in Deed Book No. 321, at Page No. 432, as LOT NO. TWENTY FIVE (25), and which said lot is more particularly bounded and described as follows, to-wit: BEGINNING at a marker at the bend in Main Road, corner to Lot No. 24, and running with said road, S. 29 E. 165 feet to a corner to Lot No. 26 and with the line of Lot No. 26, N. 69 W. 440 feet; thence around the hill N. 17 E. 175 feet to a corner of Lot No. 24 and with same S. 56 1/2 E. 333 feet to the BEGINNING, containing 1.11 acres, more or less; PARCEL NO. 2: All that certain piece or parcel of real estate situate near the mouth of Buffalo Creek, Ceredo District, Wayne County, West Virginia, known and designated upon a certain map or plat entitled, "Map of Valley View, Route 1, Kenova, W. Va., J. W. Alley, Surveyor", Surveyor", as LOT NO. TWENTY SIX (26), and which said real estate is more particularly bounded and described as follows: BEGINNING at a marker on the west side of the Main Road in the bend, corner to Lot No. 25 and with said Road S. 29 E. 68 feet to a marker; thence S. 7 1/2 W. 40 feet to a corner to Lot No. 27 and with same N. 80. W. 495 feet; thence around the hill N. 17 E. 175 feet to a corner of Lot No. 25 and with the same down the hill S. 69 E. 440 feet to the BEGINNING, containing 1.45 acres, more or less; EXCEPTING, HOWEVER, outconveyance of 1.051 acres, more or less, of record in Deed Book 669, Page 700; And being the same property conveyed unto Amy L. Brumfield and Richard L. Brumfield, by Carrie L. Hensley (f/k/a Carrie L. Smith), by deed bearing even date herewith, to be recorded in the Office of the Clerk of the County Commission of Wayne County, West Virginia, simultaneously with this deed of trust, the note secured hereby representing a portion of the purchase price of the subject property. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 440 Valley View Drive, Kenova, WV 25530. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk's Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in "AS IS" condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $9000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
