NOTICE NOTICE OF TRUSTEE SALE Pursuant to the authority vested by Deed of Trust dated the 19th day of December, 2008, Paul R. Staley and Summer R. Staley, Grantors, to Philip Andrew Vallandingham and Samuel A. Vallandingham, Trustees, which said Deed of Trust is of record in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Trust Deed Book 2257, beginning at page 274, and the undersigned, Daniel T Yon and Melissa Eakle Leasure, substituted Trustees, by Substitution of Trustees of record in the office of the Clerk of the County Commission of Cabell County in Bonds, Contracts and Leases Book 389 at page 357 having been requested to do so by the Lender, and default having been made under the terms and conditions of said Deed of Trust, and the provisions of said Deed of Trust concerning acceleration having been complied with by the Lender and present holder of the note, said substituted Trustees shall sell at public auction on August 30, 2017 at 11:00 a.m. at the front steps of the courthouse of Cabell County, West Virginia, the following real estate more particularly described as follows: BEGINNING at a point on corner of Lots 105 and 107 and on right of way line of Whistle Stop Drive; thence running with Lot 107, N 86 13' 14" E 85.77 feet to a point on corner of Lots 105 and 107 and a right of way consisting of 25 feet; thence running with the right of way of 25 feet, S 12 09' 00" E 48.00 feet to a point on corner of Lots 103 and 105; thence with Lot 103, S 86 13' 14" W 92.76 feet to the corner of Lots 103 and 105, and a point on right of way line of Whistle Stop Drive; thence running with Whistle Stop Drive, N 03 46' 46" W 47.50 feet to the beginning containing 0.09 acre. TERMS OF SALE: Ten percent (10%) of total bid amount cash in hand on day of sale. Remainder due within 30 days from date of Trustee Sale. Payment for unpaid real estate taxes to be assumed by the purchaser. Subject to any and all assessments and taxes against said property, and all prior liens and encumbrances of any nature whatsoever. The purchaser shall be responsible for the payment of the transfer taxes imposed by Article 2 of Chapter 11 of the West Virginia Code. Any sale hereunder may be adjourned from time to time without any notice other than the oral proclamation at the time and place appointed for this sale or by posting of a notice of same. Subject to the right of the Internal Revenue Service to redeem the property as provided by Section 7425 of the Internal Revenue Code, as amended. Any sale may be conducted or adjourned by the designated agents or attorney of the Trustee. The undersigned is fully vested with the authority to sell said property as substituted Trustee.
