NOTICE OF TRUSTEE SALE OF VALUABLE REAL ESTATE Pursuant to the authority vested in the undersigned by Deed of Trust dated the 21st day of February, 2014, signed by Joel Ray Cook and Judy Carol Cook, husband and wife, to Emma Byrnside, Trustee, which said Deed of Trust is of record in the Office of the Clerk of the County Commission of Boone County, West Virginia, in Trust Deed Book 344, at Page 519, and Stephanie L. Abraham, acting as Substitute Trustee, by virtue of the Appointment of Substitute Trustee dated July 28, 2017, having been recorded in the aforesaid Clerk's Office, said Trustee having been requested so to do by the Secured Creditor, and default having been made under the terms and conditions of said Deed of Trust, and the provisions in said deed of trust concerning acceleration having been complied with by the Secured Creditor and present holder of the note, said Trustee will sell at public auction at 9:15 o'clock a.m. on the 6th day of September, 2017, at the front doors of the Courthouse in Boone County, in Madison, West Virginia, the following described real estate: All that certain lot or parcel of real estate situate, lying and being on the in Crook District, Boone County, West Virginia, described as follows: Lot No. 31, Section No. 3, in the Town of Wharton, in Crook District of Boone County, West Virginia, as said lot is shown on a map which is one of a series of maps of record in the Office of the Clerk of the County Commission of said Boone County in Map Book 19, at Page 26, consisting of separate maps of Section Nos. 1 through 16, the index map to which bears the following legend: EASTERN ASSOCIATE COAL CORP. There is further hereby conveyed unto the said parties of the second part, their successors and assigns, the right to use all the street and alleys shown on said maps, in common with the public generally. It is the intention of this notice to sell the secured property by proper description as was intended to be transferred and conveyed in the aforesaid deed of trust. TERMS OF SALE: Cash in hand on day of sale or within 30 days of date of sale upon terms to be agreed upon between Trustee and successful bidder, time being of the essence; payment for unpaid real estate taxes to be assumed by the purchaser. The Trustee does not warrant title or fitness to this property; it is being purchased as is; this is a buyer beware sale and any buyer is advised to retain counsel before the sale. If there is any part of the process of sale which is found to be objectionable, the Trustee reserves the right to cancel the sale. No purchaser should take possession or make improvements in the premises until the Trustee deed is delivered or recorded.
