TRUSTEE'S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated November 17, 2003, and duly recorded in the Office of the Clerk of the County Commission of Wayne County, West Virginia, in Document No. 128238, in Book No. 582, at Page 68, Larry Burley did convey unto Richard A. Pill, Esq., Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated October 15, 2015, and recorded in the aforesaid Clerk's office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Wells Fargo Bank, N.A., to foreclose thereunder, will offer for sale at public auction at the front door of the Wayne County Courthouse in Wayne, West Virginia, on September 19, 2017 at 2:45 PM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Huntington (Westmoreland) District, Wayne County, West Virginia, and more particularly described as follows: PARCEL ONE: All that certain lot or parcel of property on Chase Street in City of Huntington in Wayne County, West Virginia being more particularly described as follows: Beginning at a rebar and cap (set) in the south right of way line of Chase Street and at the northeast corner of Lot #5; Thence leaving lot #5 and running with said right of way line, North 68-41-11 East 120.50 feet to a concrete monument (found) at the northwest corner of Lot #8 Block "U" Vinson Place; Thence leaving Chase Street and running with the west line of Lot #8 Vinson Place, South 21-18-49 East 139.96 feet to a one inch pipe (found) at the north right of way line of the C&O Railway Company; thence leaving to #8 Vinson Place and running with said right of way line, South 77-40-45 West 122.00 feet to a rebar and cap (set) at the southeast corner of Lot #4; thence leaving the C&O Railway and running with the east line of Lot #4, North 21-18-46 West 120.89 feet to the point of beginning containing 15,716.2 square feet or Three Hundred Sixty One Thousandths (0.361) Acre and being all of Lots #1, #2, and #3. PARCEL TWO: All that certain lot or parcel of property on Chase Street in City of Huntington in Wayne County, West Virginia being more particularly described as follows: Beginning at a rebar and cap (set) in the south right of way line of Chase Street and at the northeast corner of Lot #5; Thence leaving Lot #5 and running with said right of way line; North 68-41-11 East 40.00 feet to a rebar and cap (set) at the northwest corner of Lot #3; Thence leaving Chase Street and running with the west line of Lot #3, South 21-18-49 East 120.89 feet to a rebar and cap (set) at the north right of way line of the C&O Railway Company; Thence leaving Lot #3 and running with said right of way line; South 77-40-45 West 40.50 feet to a rebar and cap (set) at the southeast corner of Lot #5; Thence leaving the C&O Railway and running with the east line of Lot #5, North 21-18-49 West 114.56 feet to the point of beginning containing 4,709.0 square feet or One Hundred Eight Thousandths (0.108) Acre and being all of Lot #4. As more fully shown on attached Plat. And being the same property conveyed unto the Bill M. Powell, Alma T. Powell and Bill M. Powell, Jr. by Deed recorded in Deed Book 590 at Page 580 in the Office of the Clerk of the County Commission of Cabell County, West Virginia. The said Alma T. Powell having died testate on June 11, 2000 and all interest herein having passed by virtue of survivorship to the Grantors. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 3633 Chase Street, Huntington, WV 25704. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk's Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in "AS IS" condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $5000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
