NOTICE OF TRUSTEE'S SALE NOTICE OF TRUSTEE'S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated November 9, 2011, executed by Borrower(s), Paul G Tawney, to U.S. Bank Trust Company National Association, the Trustee of record in the office of the Clerk of the County Commission of Boone County, West Virginia, in Book 331, at Page 581. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 333 Emma Ln, Foster, WV 25081. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated June 19, 2017, of record in the Clerk's Office in Book 367, Page 652. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Boone County, in Madison, West Virginia, on the following date: 11th day of September, 2017 at 11:00 a.m. The property is described as of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Scott District, Boone County, West Virginia, and being more particularly described as follows: All that certain tract or parcel of land situate on ridge between Left Fork and Right Fork of Rock Creek, Scott District of Boone County, Foster, WV, bounded and described as follows: Beginning at a 1/2 inch rebar/cap, common corner to Lots 1, 2, & 5, running with the common line of Lots 2 & 5, North 18 degrees 24 minutes West - 50.27 feet to a 1/2 inch rebar/cap, common corner to Lots 2, 4, &5; thence running with the common line of Lots 2 & 4, North 49 degrees 30 minutes West - 74.37 feet to a 1/2 inch rebar/cap, continuing with Lot 4, North 38 degrees 54 minutes West - 96.50 feet to a 1/2 inch rebar/cap, common corner to Lots 2, & 3 & 4; thence running with the common line of Lots 2 & 3, South 75 degrees 04 minutes West - 109.49' to a 1/2 inch rebar/cap on the eastern right-of-way of a 20 foot road, continuing and crossing 20 foot road, South 75 degrees 04 minutes West -321.47 feet to a 1/2 inch rebar/cap, common corner to Lots 2 & 3, located on the eastern right-of-way line of County Route 119/2; thence running up and with said right-of-way on a curve for a distance of 329.17 feet, with a radius of 560.44 feet, on a chord of South 13 degrees 48 minutes East - 324.46 feet to a 1/2 inch rebar/cap, common corner to Lots 1 & 2; thence running with the common line of Lots 1 & 2, crossing a 20 foot road, North 61 degrees 37 minutes East - 346.10 feet to a 1/2 inch rebar/cap, continuing North 61 degrees 37 minutes East - 190.42 feet to the point of beginning and containing 3.07 acres, more or less, and depicted as Lot 2 on a Plat of Survey prepared by Johnny R. Along with easements and rights of way running from the County Road along what is shown on the Plat as "Dolin Hill Road" and then a 20 foot wide right of way off "Dolin Hill Road" both shown on the Plat and which said easements and rights of way are for the purpose of ingress and egress from the County Road to the property herein conveyed. TERMS OF SALE: 1) The property will be conveyed in an "AS IS" physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk's office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
