NOTICE OF TRUSTEE'S SALE Notice is hereby given that by virtue of authority vested in the undersigned Trustee by that certain deed of trust executed by TERRA ANN JONES to FLYNN, MAX, MILLER & TONEY, L.C., dated the 14th day of July, 2010, securing BETTY L. CLAY, and recorded in the office of the Clerk of the County Commission of Cabell County, West Virginia, in Trust Deed Book No. 2340, at page 382, by which was conveyed to the said Trustee the hereinafter described real estate, to secure the payment of a certain note set out and described therein, having been requested so to do by the owner and holder of said note, shall sell to the highest and best bidder, on September 26, 2017 at 10:00 A.M., at the East Front Door of the Court House of Cabell County, West Virginia, the following described real estate: All that certain lot, piece, or parcel of land situate in the McComas District, Cabell County, West Virginia on the waters of the Guyandotte River, and is located on West Virginia State Local Service Route 31, commonly known as Barboursville- Hamlin Turnpike, approximately 1 mile south of Barboursville, and being more particularly described as follows: BEGINNING at a rebar (set) in concrete in the west line of a 0.68 acre parcel of land now owned by James Mannon (deed book 1066, page 499); thence leaving the said Mannon line and severing the tract ofland now owned by Betty Clay (Will Book 149, Page 717) South 84 45' 27" West, a distance of 155.40 feet to the east edge of a 40 foot right of way for the said Barboursville-Hamline Turnpike and is North 84 45' 27" East, a distance of 2.36 feet from a rebar (set) in concrete; thence along and with the said right of way North 12 15' 56" East, a distance of 62.20 feet to the intersection with a tangent curve to the right having a radius of 199.31 feet and a central angle of 47 49' 14"; thence northeasterly along the arc of said curve to the right, from which the local tangent at the beginning bears North 12 15' 56" East, a distance along the arc of 166.35 feet, said arc subtended by a chord which bears North 36 10' 33" East, a distance of 161.56 feet, to the intersection with non-tangent line at the east edge of the said 40 foot right of way, and being the northwest comer of a parcel ofland now owned by the said Mannon; thence along and with Mannon's west line South 14 37' 00" East, a distance of 182.92 feet to the BEGINNING, containing 17,918.566 Square Feet or 0.411 Acres of land, more or less, as shown and the plat attached hereto and made part of this instrument. TERMS OF SALE: Cash in hand on day of sale, and subject to any and all unpaid taxes. Given under my hand this 1st day of September 2017.
