TRUSTEE'S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated May 17, 2005, and duly recorded in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Document No. 216118, in Book No. 2009, at Page 503, Edward L. Fowler and Andrea D. Fowler did convey unto Richard A. Pill or David D. Pill, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated August 21, 2017, and recorded in the aforesaid Clerk's office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by U.S. BANK TRUST NATIONAL ASSOCIATION, AS TRUSTEE OF BUNGALOW SERIES F TRUST, to foreclose thereunder, will offer for sale at public auction at the front door of the Fourth Avenue Entrance of the Cabell County Courthouse in Huntington, West Virginia, on October 24, 2017 at 1:30 PM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Guyandotte District, Cabell County, West Virginia, and more particularly described as follows: Situated in the State of West Virginia, County of Cabell and in the District of Guyandotte. All that certain lot, piece or parcel of land, situate in Guyandotte District, Cabell County, West Virginia on the waters of Four Pole, a tributary of the Ohio River and is located on State Local Service Route 35, known as Green Valley Road and is about 1.1 miles south of its intersection with West Virginia State Route Ten, designated hereafter as PARCEL TWO, and being more particularly described as follows: Beginning at a Rebar (set) at the southwest corner of a tract of land now or formerly owned by Fowler (Deed Book 1067, page 417) and the said beginning bears North 45 degrees 36 minutes 02 seconds West, a distance of 4.71 feet from a PK nail in a concrete driveway; Thence crossing the said driveway South 13 degrees 01 minutes 34 seconds West, a distance of 34.15 feet to a 5 inch by 32 inch rebar (set) with an orange plastic cap labeled 'D. Porter H&T PLS 357; Thence South 40 degrees 55 minutes 57 seconds West, a distance of 94.23 feet; Thence North 34 degrees 22 minutes 00 seconds West, a distance of 97.48 Feet to a point in the East line of a tract of land now owned by Jay Hatcher (Deed Book 1069, page 308). Thence North 46 degrees 17 minutes 48 seconds East, a distance of 104.22 feet; Thence South 45 degrees 36 minutes 02 seconds East, a distance of 68.70 feet to the Beginning, containing 9,997.536 square feet or 0 acres, more or less, as shown on the attached plat which is to be recorded as a part of this instrument. Together with a 15 foot strip easement at all times and for all purposes connected with the use and enjoyment of the land previously conveyed and the grantor's remaining premises, in common with all other persons having the like right at all times hereafter, to pass and re-pass over and along the 15 foot easement as designated 7.5 feet right and left of a centerline through parcel one, and through another tract of land now or formerly owned by Fowler (deed book .1067, page 417) and additionally along an extension of this easement the description of which is recorded in Deed Book 1062, at page 264, and as extended to the public road known as West Virginia State Local Service Route 35, Green Valley Road; Subject, however to a 15 foot strip easement entirely across the land described above and extending from the Hatcher land to easement described above, the actual location of the easement is to be where the existing driveway is at this present time. Map #: 11, Parcel 70 Parcel No: 15496 Commonly known as: 4014 1/2 Apartment Earl Drive, Huntington, WV 25701 At the time of the execution of the Deed of Trust, this property was reported to have an address of: 4014 1/2 Earl Drive Apartments, Huntington, WV 25701. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk's Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in "AS IS" condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $6000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
