NOTICE OF FORECLOSURE SALE OF REAL ESTATE The undersigned Trustee, pursuant to West Virginia Code 38-1-4, and by virtue of the authority vested in him by that certain Deed of Trust dated April 21, 2014, and duly recorded in the Office of the Clerk of the County Commission of Mingo County West Virginia, in Trust Deed Book 447, at Page 243, wherein Anthony Frealin Browning and Patrick Keith Browning, did convey unto Greg K. Smith, Trustee, to secure payment unto Clifford Baisden and Rosemary Baisden, his wife, certain real property described in said Deed of Trust; and default for nonpayment and maintaining insurance having been made under the aforementioned Deed of Trust, and the undersigned Trustee having been instructed by the secured parties to foreclose thereunder, will offer for sale by public auction at the front door of the Mingo County Courthouse, 75 East Second Avenue, Williamson, in Mingo County, West Virginia, on Friday, November 17, 2017, 10:00 A.M. The following described real estate with its improvements, easements and appurtenances thereunto belonging, situate in the Harvey District, Mingo County, West Virginia and more particularly described as follows, to-wit: "Beginning at a stake nine (9) feet below the storage tank, thence running with the state right of way up the state road to a stake nine (9) feet above the existing store structure (including what is known as the walk in cooler), thence turning left and running straight up the hill to the back of the property line, thence turning left and running along the hill with said property line to a stake, thence turning left and running down the hill in a straight line to the point of beginning." At the time of the execution of the Deed of Trust this property was reported to have a mailing address of Breeden, Mingo County, West Virginia 25666. And being the same real estate which was conveyed to Anthony Frealin Browning and Patrick Keith Browning by deed dated April 21, 2016, from Rosemary Baisden and Clifford Baisden, her husband, which is of record in Deed Book 456, Page 289, in the Office of the Clerk of Mingo County, West Virginia. The above described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes. The subject property will be sold in "AS IS" condition. The Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
