TRUSTEE'S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated May 25, 2005, and duly recorded in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Book No. 2011, at Page 183, Brian J. McClellan and Susan McClellan did convey unto Carl H. Cather, III, Esq., Spilman, Thomas, & Battle, PLLC, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated December 14, 2016, and recorded in the aforesaid Clerk's office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Federal National Mortgage Association ("Fannie Mae") to foreclose thereunder, will offer for sale at public auction at the front door of the Fourth Avenue Entrance of the Cabell County Courthouse in Huntington, West Virginia, on November 21, 2017 at 1:30 PM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Guyandotte District, Cabell County, West Virginia, and more particularly described as follows: SITUATED IN THE STATE OF WEST VIRGINIA, COUNTY OF CABELL AND IN THE DISTRICT OF GUYANDOTTE BEGINNING AT AN IRON PIPE 11.7 FEET SOUTH OF THE SOUTH EDGE OF THE CONCRETE ROAD, AND AT RIGHT ANGLES THERETO (SAID BEGINNING CORNER BEING THE NORTH EAST CORNER OF LOT NO. 1 OF SAID SUB DIVISION); THENCE ALONG THE RIGHT OF WAY OF SAID HARD ROAD, S. 77 DEGREES 35' E. 130 FEET TO AN IRON PIPE; THE NORTH WEST CORNER TO LOT NO. 3 AND 12 FEET SOUTH OF THE SOUTH EDGE OF SAID HARD ROAD, AND AT RIGHT ANGLES THERETO; THENCE LEAVING SAID ROAD AND RUNNING DOWN THE HILL WITH THE WEST LINE OF SAID LOT NO. 3, S. 12 DEGREES 30' WEST AT 165 FEET PASSING AN IRON PIN, THE SOUTH WEST CORNER TO SAID LOT NO. 3 AND 97 FEET MORE, IN ALL 262 FEET, TO AN IRON PIN BY SAME ASH SPROUTS ON THE SOUTH SIDE OF A DRAIN, A CORNER TO LOT NO. 9; THENCE WITH THE LINE OF SAID LOT DOWN SAID DRAIN S. 82 DEGREES 10' WEST AT 86.7 FEET A SMALL FORKED ASH, THE NORTH WEST CORNER TO SAID LOT NO. 9, ALSO A CORNER TO DELLA PRICE TRACT; THENCE CONTINUING SAID COURSE DOWN THE SOUTH SIDE OF SAID DRAIN, 100.6 FEET TO AN IRON PIPE 12 FEET SOUTH OF SAID DRAIN, THE SOUTH EAST CORNER TO LOT NO. 1; THENCE LEAVING THE DELLA PRICE LAND AND RUNNING UP THE HILL WITH THE EAST LINES OF AID LOT NO. 1, 14 35' E. 187.1 FEET TO AN IRON PIPE; THENCE N. 88 DEGREES 15' E. 145.7 FEET TO THE BEGINNING, CONTAINING 1.9 ACRES, MORE OR LESS. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 4553 Green Valley Rd, Huntington, WV 25701. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk's Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in "AS IS" condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $4000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
