NOTICE OF SUCCESSOR TRUSTEE'S SALE NOTICE OF SUCCESSOR TRUSTEE'S SALE is hereby given pursuant to and by virtue of the authority vested in the Successor Trustee by that Deed of Trust, granted to First Sentry Bank, Inc., successor in interest by statutory merger with Rock Branch Community Bank, by borrower, Fern B. Hunter, dated May 26, 2010 and recorded on June 2, 2010 in the office of the Clerk of the County Commission of Putnam County, West Virginia (the "Clerk's Office"), in Trust Book 938, at Page 752. Matthew L. Ward ("Successor Trustee") was appointed as Trustee by APPOINTMENT OF SUCCESSOR TRUSTEE dated November 13, 2017 and recorded in the Clerk's Office on November 20, 2017 in Book 1175, at Page 741. The borrower(s) have defaulted under the Note and Deed of Trust and the Successor Trustee has been instructed, by First Sentry Bank, Inc. to foreclose under the Deed of Trust. Accordingly, the Successor Trustee will sell the following described property to the highest bidder at the front door of the Courthouse of Putnam County, in Winfield, West Virginia, on: FRIDAY, January 12, 2018, AT 10:00 A.M. The property is described as that certain parcel of land, together with all improvements thereon and the appurtenances thereto, and being more particularly described as follows: BEGINNING at an iron pin situate in the common division line of the land of the part of the first part and of the lane of the Haven of Rest Memorial Gardens, Inc., a corporation, and certain lot, tract or parcel of land consisting of 0.8 acres and being formally conveyed by Luigi Lemma and Teresa Lemma, his wife, unto Faille William Surface and Virginia Surface, his wife, said conveyance dated May 17, 1951 and of record in the Office of the Clerk of the County Court of Putnam County, West Virginia, in Deed Book No. 101, at pages No. 41; thence continuing with the common division line of the land of the party of the first part herein and the land of the Haven of Rest Memorial Gardens, Inc. and leaving the line of the parcel consisting of 0.8 acre formally conveyed by Luigi Lemma and Teresa Lemma, his wife, unto Faille William Surface and Virginia Surface, by said conveyance of May 17, 1951, S. 52 degrees 54' W., 217 feet, more or less, to an iron post at the top of a steep bank, 245 feet north east of the end post; thence continuing with the said division line of the land of the party of the first part herein and the land of the Haven of Rest Memorial Gardens, Inc., N. 76 degrees 30' W., and following an old fence line a distance of 62 feet to an iron pin set in the said fence line; thence continuing with said common division line, S. 85 degrees 10' W., 164 feet to an iron pipe: thence continuing with said division line N. 89 degrees 46' W., 27 feet to an iron pipe; thence continuing with said division line S. 61 degrees 54' W., 616 feet to an iron pipe set in the easterly boundary of the New York Central Railroad Company right of way, said point being N. 49 degrees 50' W., 45 feet from the center of a 9 x 16 foot box culvert; thence leaving the common division line of the land of the party first part herein and the land of the Haven of Rest Memorial Gardens, Inc., and with the easterly boundary line of the New York Central Railroad Company, S. 49 degrees 50' E., 144 feet to an iron pin; thence leaving the said line of the lane of the New York Central Railroad Company, N. 75 degrees E., 986 feet, more or less, to an iron pin in the line of the parcel herein conveyed and the said land consisting of 0.8 acre, more or less, said parcel formally owned by Faille William Surface and Virginia Surface; thence with the line of the 0.8 acre parcel of land, N. 23 degrees 30' W., 270 feet; more or less, to the beginning; it being the intention of the party, of the first part by this conveyance to convey unto the said partied of the second part, all the land owned by the party of the first part herein, situate between the 0.8 acre tract of land conveyed by Luigi Lemma and Teresa Lemma, his wife, unto Fallie William Surface and Virginia Surface, his wife, by conveyance dated the 17th day of May, 1951, and the land of the New York Central Railroad Company; Two certain tracts or parcels of land situate in Union District, Putnam County, West Virginia, more particularly bounded and described as follows: Parcel No. 1: BEGINNING at a point on the southerly edge of U.S. Highway No. 35, which point is also a corner to the property of the parties of the first part and Frank Harman; thence with the southerly line of said U.S. highway 487 feet to a stake at or near a bridge over little Guano Creek; thence S. 77 degrees 10' W. 426 feet to a stake, corner to a lot this day conveyed by the parties of the first part to FaIley Surface; thence with a line of said Surface N. 19 degrees 30' W. 328 feet to a fence post in the line between the first parties property and the of Frank Harman; thence with said dividing line N. 54 degrees 30' E. 267 feet to the place of beginning, containing 3.14 acres more or less. Parcel No. 2: BEGINNING at a point on the north line of the New York Central Railroad right of way, corner between Luigi Lemma and Frank Harman; thence with the dividing line between Lemma and Harman N. 67 degrees 25' E. 620 feet to a stake; thence S. 88 degrees E. 247 feet to an iron pin; thence N. 54 degrees 30' E. 208 feet to an Elm Tree, which point is also a corner to the lot this day conveyed to Falley Surface; thence with a line of said FaIley Surface lot S. 23 degrees 30' E. 270 feet to a stake; thence S. 77 degrees 10' W. 986 feet to a point in the right of way line of the New York Central Railroad Company; thence N. 46 degrees 41' W. 140 feet to the place of beginning. Conveyance of Parcel No. 1, hereinabove described, is made subject to a 16-foot driveway along and near the westerly side thereof as shown on the map hereinafter referred to, for the use and benefit of said lot, of parcel No. 2 hereinabove described, and of lot this day conveyed to FaIley Surface. Excepting from this property a previous conveyance of a portion of the above described property that was outwardly conveyed by Lewis H. Hunter aka Louis H. Hunter aka Lewis Hoyt Hunter aka Louis Hoyt Hunter and Fern B. Hunter, his wife, by deed dated January 2, 1979 and recorded on January 22, 1979 in the Clerk's Office in Book 239, at Page 774. The outwardly conveyed, and excepted, property being more particularly described as follows: BEGINNING at a 1/2" iron rod set in the southern line of West Virginia State Route 62, same being S. 40-16 E. 36.00 feet from a '/2" iron rod set in a fence post which was found to be the old original common corner to property now owned by the cemetery as recorded in Deed Book 142, at Page 543; thence S. 40 16 E. with West Virginia State Route 62, 16.00 feet to a '/2" iron rod set at the eastern corner of a 16.00 foot right of way; thence S. 40-16 E. with West Virginia State Route 62, 218.83 feet to a '/2" iron rod set; thence S. 40-16 E. with West Virginia State Route 62, 152.80 feet to a'/2" iron rod set; thence leaving said West Virginia State Route 62 and running five (5) new division lines through the Lewis H. Hunter 3.14 Ac. Tract as recorded in Will Book 7, at Page 227, as follows: S. 66-59 W. running closely to an old fence and the waters of the Little Guano Creek 137.39 feet to a'/2" iron rod set; thence N. 39-57 W. 234.95 feet to a'/2" iron pipe set; thence N. 39-57 W. 110.13 feet to a 1/2" iron rod set in the eastern line of the aforementioned 16.00 foot right of way; thence N. 39-57 W. 16.00 feet to a '/2" iron rod set at the western line of the said 16.00 foot right of way; thence N. 56-00 E. running with said western line of the 16.00 foot right of way 130.00 feet to the beginning, containing 48,775.94 square feet = 1.12 acres, more or less, as surveyed in November-December 1978 by Jarrel A. Clendenin, L.L.S. #259 of 601 Pawnee Drive, Charleston, West Virginia, and shown on the plat attached to the aforementioned deed above (i.e. Book 239, at Page 774). Common Address: 93 Coveside Place, Red House, West Virginia 25168 TERMS OF SALE: 1. The property will be conveyed in an "AS IS, WHERE IS" physical condition by Deed containing no warranty, express or implied; 2. Subject to any and all assessments and taxes against said property, and all prior liens and encumbranes of any nature whatsoever; 3. The purchaser shall be responsible for the payment of the transfer taxes imposed by Article 22 of Chapter 11 of the West Virginia Code; 4. The Beneficiary and/or Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale; 5. The Successor Trustee reserves the right to adjourn the sale, for a time, or from time to time, without further notice by announcement at the time and place of sale described above or any adjournment thereof; 6. The Successor Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate the property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY; 7. The total purchase price is payable to the Successor Trustee by cashier's check, cash or the equivalent within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale by cashier's check, cash or t equivalent.
