NOTICE NOTICE OF TRUSTEE SALE Pursuant to the authority vested by Deed of Trust dated 20th day of February, 2009, Allied Financial Services, Inc., Grantor, to Philip A. Vallandingham and Samuel A. Vallandingham, Trustees, which said Deed of Trust is of record in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Trust Deed Book 2274, beginning at page 255, and the undersigned, Daniel T Yon and Melissa Eakle Leasure, substituted Trustees, by Substitution of Trustees of record in the office of the Clerk of the County Commission of Cabell County in Bonds, Contracts and Leases Book 388 at page 74, having been requested to do so by the Lender, and default having been made under the terms and conditions of said Deed of Trust, and the provisions of said Deed of Trust concerning acceleration having been complied with by the Lender and present holder of the note, said substituted Trustees shall sell at public auction on November 9, 2016 at 11:00 a.m. at the front steps of the courthouse of Cabell County, West Virginia, the following real estate particularly described as follows: All that certain lot, piece or parcel of ground situate in the City of Huntington, Cabell County, West Virginia, known and designated on the revised map of the said City of Huntington, made by L. W. Leete, Civil Engineer, which map was filed in Cabell County Court Clerk's Office on the 31st day of December, 1903, as the northerly part of LOT NUMBER ELEVEN (11), in BLOCK NUMBER TWO HUNDRED AND FORTY-NINE (249), described as follows: BEGINNING at a point in the south line of Third Avenue, Four Hundred (400) feet east of the east line of Twenty-fifth Street; thence easterly with the south line of Third Avenue, Forty (40) feet to a street (40 feet in width) known as Lynda Court (formerly Twenty-Five and One-Half Street); thence southerly with the west line of said Lynda Court, One Hundred and Seven (107) feet to a stake; thence westerly with the south line of Third Avenue, Forty (40) feet to a stake; thence northerly, parallel with Lynda Court, One Hundred and Seven (107) feet to the BEGINNING. TERMS OF SALE: Ten percent (10%) of total bid amount cash in hand on day of sale. Remainder due within 30 days from date of Trustee Sale. Payment for unpaid real estate taxes to be assumed by the purchaser. Subject to any and all assessments and taxes against said property, and all prior liens and encumbrances of any nature whatsoever. The purchaser shall be responsible for the payment of the transfer taxes imposed by Article 2 of Chapter 11 of the West Virginia Code. Any sale hereunder may be adjourned from time to time without any notice other than the oral proclamation at the time and place appointed for this sale or by posting of a notice of same. Subject to the right of the Internal Revenue Service to redeem the property as provided by Section 7425 of the Internal Revenue Code, as amended. Any sale may be conducted or adjourned by the designated agents or attorney of the Trustee. The undersigned is fully vested with the authority to sell said property as substituted Trustee.
