NOTICE OF PROPOSED CONVEYANCE OF UNITED METHODIST CHURCH PROPERTY (Z. WARNER UNITED METHODIST CHURCH) Notice is hereby given that the Board of Trustees of the West Virginia Annual Conference of the United Methodist Church will, on or after November 19, 2016 upon the payment of the sum of Twenty-Four Thousand Five Hundred Dollars ($24,500.00) in cash, QUITCLAIM, SELL, and CONVEY to Trustees of the Z. Warner Church, all of their right, title and interest, in and to those certain lots or parcels of real estate, situate, lying and being in Union District, Cabell County, West Virginia, and bounded and described as follows, to-wit: PARCEL ONE: BEGINNING at a stone on Seven-Mile creek, four feet east of two willows and a ravine; thence North-easterly direction, one hundred seventy-seven (177) feet to a fence post and stone, fifteen feet west of a stone marked with a cross (X); thence, easterly 346 feet to a small blackjack bush and stone; thence, in a southwesterly direction fifty-eight (58) feet to a stone, five feet from a sassafras bush (also marked with a stone); thence in a westerly direction, three hundred twenty-three (323) feet to the place of beginning, and containing one acre, more or less. And being the same property conveyed from Rev. G. W. Simpson and Nellie Simpson, his wife to S. T. Roberts, E. A. Williams, Thomas J. Joy, S. M. Jefferson and John Jarvis, Trustees of Z. Warner Chapel, United Brethren Church, by Deed dated October 5, 1926 and of record in the Office of the Clerk of the County Commission of Cabell County, West Virginia in Deed Book 243, at page 439. PARCEL TWO: Beginning at a stone on Seven Mile Creek 4 feet East of a ravine and a corner to the Z. Warner Church lot; thence with line of said Z. Warner Church lot in a Northerly direction 177 feet to a fence post and stone, corner to the said Z. Warner Church lot And G, W. Simpson's land; thence in a Westerly direction 100 feet to a stone between two fence posts; thence in a Southerly direction approximately 190 feet to a point in the line of the said G. W. Simpson and J. A. Simpson; thence with the line of the said G. W. Simpson and J. A. Simpson in an Easterly direction 80 feet to a point opposite to the place of beginning and in line with said beginning point and the first described line of this lot; thence in a Northerly direction approximately 13 feet to the place of beginning, and containing four-tenths (.4) acre, more or less. And being the same property conveyed from Max White, Willie Weed, Judson Barnett, Losey Chapman and Clyde Miller, Parsonage Trustees for the Huntington Circuit of the United Brethren Church to Trustees of the Z. Warner Evangelical United Brethren Church, by Deed dated January 2, 1953 and of record in the aforesaid Clerk's Office in Deed Book 470, at page 234. PARCEL THREE: BEGINNING at an X on a rock on the south bank of Big Seven Mile Creek, the same being a corner to J. A. Simpson; thence running with said J. A. Simpson line up the creek N 72 35' E 179 feet; thence leaving said Simpson line crossing the creek and road N 9 26' W 198.7 feet to a stone on the hillside; thence S 87 19' W 200 feet to a stone near a walnut tree; thence S 14 20' E 248 feet to the BEGINNING, containing one (1) acre, more or less. And being the same property conveyed from G. W. Simpson and Nellie Simpson, his wife, to Max White, Wilbur Suiter, Gomer White, Herbert Ryder, Junior Williams and Dale Rollyson, Trustees of Z. Warner Evangelical United Brethren Church, by Deed dated July 26, 1961 and of record in the aforesaid Clerk's Office in Deed Book 585, at page 231. PARCEL FOUR: BEGINNING at an iron pipe (set) on the north right-of-way line of West Virginia Secondary State Route No. 11, more commonly known as Big Seven 7 Mile Road, the said point is in the lands now owned by Phyllis Ann Smith, (D. B. 668, Pg. 483) from which the southwest corner of the existing brick church bears North 82 43' East 206.87 feet; thence, leaving the said Route No. 11, and severing the lands of the said Smith, as follows: North 22 08' East passing an iron pipe (set) at 82.59 feet, in all 127.44 feet to an iron pipe (set), North 62 29' East 94 . 52 feet to the call of a stone near a walnut tree, marking a corner common to the lands now owned by the Trustees of Z. Warner Evangelical United Brethren Church, (D.B. 585, Pg. 231); thence, with the lands of the said Church Trustees, South 13 05; East 181.82 feet to a point on the said north right of way line of the said Route No. 11; thence, leaving the lands of the said Church Trustees, and with the said right of way line, as follows: South 76 25' West 17.97 feet; thence, with a curve to the right, having a radius of 221.08 feet, for a distance of 160.26 feet, the long chord of which bears: North 82 49' West 156.77 feet to the BEGINNING, containing 0.480 acre, more or less, as surveyed by Ronald L. Eastham and Associates, on July 15, 1986, as shown on the attached plat and made a part of this description and intended to be recorded herewith. And being the same property conveyed from Phyllis Ann Smith and Herman Smith, her husband, to Trustees of Z. Warner Evangelical United Methodist Church, by Deed dated July 18, 1986 and of record in the aforesaid Clerk's Office in Deed Book 875, at page 715. PARCEL FIVE: BEGINNING: at a stone on the north side of the seven mile paved road, the same being a corner to the Z. WARNER CHURCH lot, thence running with said church lot S. 78 40' W. 335 feet to a stone about four feet east of the south of a culvert, thence with the J. A. Simpson line S. 76 30' E. 190 feet, N. 30 E. 39 feet to a stake at the road, thence S. 84 30' E. 144 feet to a point on the south side of said road, thence crossing the road N. 12 30' W. 84 feet to the beginning, containing (ONE THIRD) acre more or less. And being the same property conveyed from Michael E. Simpson, married, and Jeannine A. Rutherford, married, as Beneficiaries under the Last Will and Testament of Layne Simpson, to Z-Warner United Methodist Church, by Deed dated October 5, 2004 and of record in the aforesaid Clerk's Office in Deed Book 1131, at page 293. Said Z. Warner United Methodist Church having been declared discontinued and/or abandoned by the regular 2016 session of the West Virginia Annual Conference of the United Methodist Church.
