NOTICE OF TRUSTEE'S SALE NOTICE OF TRUSTEE'S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated October 25, 2004, executed by the Borrower, Lisa E. Creasy, to Richard Pill, the Trustee, of record in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Book 1970, at Page 723. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 662 Fudge Creek Road, Barboursville, WV 25504. Pill & Pill, PLLC was appointed as Substitute Trustee by an APPOINTMENT OF SUCCESSOR TRUSTEE dated September 12, 2016, of record in the Clerk's Office in Book 387, at Page 736. The Borrower defaulted under the Note and Deed of Trust and the Substitute Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustee will sell the following described property to the highest bidder at the front door of the Courthouse of Cabell County, in Huntington, West Virginia, on the following date: December 8, 2016 at 1:15 p.m. The property is described as of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Grant District, Cabell County, West Virginia, and being more particularly described as follows: All that certain piece, parcel or tract of real estate situate on the waters of Fudge Creek, in Grant District, Cabell County, West Virginia, bounded and described as follows: BEGINNING at an iron pin at the sourwood stump in the exterior line of the Woodruff lands, thence with said exterior line, N. 25, 40' E. 340 feet to a stake; thence leaving said exterior line N. 64 45' W. 33 feet to a 15 inch poplar on top of the ridge; thence crossing the hollow North, N. 66 45' W. 910 feet to a hickory on the ridge; thence S. 53 00' W. 236 feet to an 8 inch black oak; thence S. 24 30' W. 108 feet to a stake, thence S. 34 30' W. 228 feet to an 8 inch pine; thence S. 19 00' W. 379 feet to a twelve inch black oak, thence S. 19 00' W. 101 feet to a stake; S. 27 00' W. 225 feet to a twelve inch chestnut oak; thence S. 37 30' W. 225 feet to a stake from which a gum and iron wood bears N. 17 15' W. 5 feet; thence S. 63 45' W. 85 feet to a stake in the exterior line of the said Woodruff lands, and corner to T. E. Walker, from which stake a black oak on top of a point bears, N. 34 45' W. 43 feet; thence with said Woodruff exterior line, S. 37 45' E. 814 feet, more or less, to a stake from which a 6 inch oak bears N. 59 30' E. 13 feet; thence N. 40 32' E. 1642 feet, more or less, to the place of the BEGINNING, containing thirty six and five tenths (36-5/10) acres, be the same more or less. For the purpose of convenience in access, a triangular corner of land is included in this conveyance, extending twenty feet beyond the southeast end of the 814 feet line; thence in a Northerly direction sixty feet to an intersection with the 1642 feet line. Being the same property conveyed to Lisa Creasy by the Deed dated October 25, 2004 and recorded in Deed Book 1131, at Page 609, in the Office of the Clerk of the County Commission of Cabell County, West Virginia. TERMS OF SALE: 1) The property will be conveyed in an "AS IS" physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk's office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6 The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
