NOTICE OF SUCCESSOR TRUSTEE'S SALE NOTICE IS HEREBY GIVEN by virtue of the authority vested in the undersigned Successor Trustee, Jonathan Nicol, by that certain Substitution of Trustee Agreement, dated April 21, 2017, executed by Bank of Mingo, recorded in the office of the Clerk of the County Commission of Wayne County, West Virginia, in Trust Deed Book 786 at page 254, being the same authority which was originally vested in David Lycan & Harry K. White, as Trustee, either of whom may act, in that certain deed of trust made by TERRY RAINES, Spouse of Crissa Raines, and CRISSA RAINES, Spouse of Terry Raines, dated November 7, 2013, recorded in said Clerk's office in Trust Deed Book 746 at page 697, the makers of the instrument secured by said deed of trust are in default, and Bank of Mingo, the current beneficial owner and holder of said instrument, has elected to treat the whole principal debt thereby secured as immediately due and payable. Thompson, L. S. No. 746, and is recorded in the office of the Clerk of the County Commission of Wayne County, West Virginia, in Map Book No. 8, at Page 146. And being the same real property conveyed unto Terry Raines and Crissa Raines, husband and wife, and the survivor thereof, from James C. Frazier, Executor of the Estate of Fanny L. Frazier, by deed dated October 1st, 2002, recorded in the office of the Clerk of the County Commission, Wayne County, West Virginia, in Deed Book No. 622, at Page 764. The property is located in Wayne County at 2483 Tabors Creek Rd., Fort Gay, West Virginia 25514. The undersigned Successor Trustee reserves the right to adjourn this sale from time to time as the interests of the parties may require, and without any notice other than by oral proclamation at the time and place appointed for sale and further reserves the right to cancel the sale in his sole and absolute discretion. This sale shall be made subject to any prior lien, liens entitled to priority over the lien created by the subject deed of trust, restrictions, conditions, reservations and easements contained in deeds or instruments of record in said Clerk's office, and subject further to all unpaid real estate taxes and special assessments, if any, the purchaser assuming the payment thereof. The undersigned Successor Trustee will deliver to the purchaser a deed conveying the subject property without any covenant or warranty, express or implied. The purchaser shall be responsible for the payment of any transfer taxes and recording fees necessary to place of record the aforesaid deed. The undersigned Successor Trustee further reserves the right to accept or reject any and all bids in his sole and absolute discretion. In the event the subject property is occupied, the undersigned Successor Trustee shall be under no duty to cause any existing tenant or occupant to vacate the subject property.
