TRUSTEE'S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated December 12, 2013, and duly recorded in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Document No. 509070, in Book No. 2515, at Page 491, Tonya L. Hysell and Timothy Eugene Hysell did convey unto Carl H. Cather, III, Esq., Spilman, Thomas, & Battle, PLLC, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated April 19, 2017, and recorded in the aforesaid Clerk's office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Pingora Loan Servicing, LLC, to foreclose thereunder, will offer for sale at public auction at the front door of the Fourth Avenue Entrance of the Cabell County Courthouse in Huntington, West Virginia, on June 6, 2017 at 1:30 PM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Barboursville District, Cabell County, West Virginia, and more particularly described as follows: THE FOLLOWING DESCRIBED REAL ESTATE: ALL THAT CERTAIN TRACT OF LAND, SITUATE IN BARBOURSVILLE DISTRICT, CABELL COUNTY, WEST VIRGINIA, AND LYING UPON AND ADJACENT TO WHAT IS KNOWN AS THE SIXTEENTH STREET OR HAMLIN ROAD, AND SHOWN UPON A MAP OF THE HANS WATTS REALTY COMPANY SUBDIVISION OF THE SHELINE PLACE, OF RECORD IN THE OFFICE OF THE CLERK OF THE COUNTY COURT OF CABELL COUNTY, WEST VIRGINIA, IN MAP BOOK NO. 2, MAP NO. 217, AS LOT NUMBER TWO (2), OF SAID SUBDIVISIONS AND BOUNDED AND DESCRIBED AS FOLLOWS: BEGINNING AT A HICKORY STANDING IN THE EASTERLY LINE OF THE 16TH STREET OR HAMLIN ROAD, CORNER COMMON TO LOT NO. 2 AND LOT NO. 3, OF SAID SUBDIVISION OF THE SHELINE PLACE; THENCE N. 51 DEGREES 30' E. 645 FEET TO A POINT IN THE SOUTHWEST CORNER OF LOT NO. 4 THEREOF, CORNER COMMON ALSO TO LOTS NO. 2 AND 3 THEREOF; THENCE N. 45 DEGREES 00' W. LSOT: DEED BOOK 1039, PAGE 633, DATED OCTOBER 16, 1998, OFFICE OF THE CLERK OF THE COUNTY COMMISSION, CABELL COUNTY, WEST VIRGINIA. THIS CONVEYANCE IS MADE SUBJECT TO ANY AND ALL COVENANTS, RESTRICTIONS, EASEMENTS AND RESERVATIONS WHICH MAY BE A MATTER OF RECORD IN THE CLERK'S OFFICE AFORESAID AND RUNNING WITH THE LAND. AND THE SAID PARTIES OF THE FIRST PART DO HEREBY COVENANT TO AND WITH THE SAID PARTY OF THE SECOND PART THAT THEY WILL WARRANT GENERALLY THE TITLE TO THE PROPERTY HEREBY CONVEYED, EXCEPT AS TO TAXES FOR THE CURRENT YEAR, WHICH ARE TO BE PRO-RATED BY AND BETWEEN THE PARTIES HERETO. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk's Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in "AS IS" condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $5000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
