NOTICE NOTICE OF TRUSTEE SALE Pursuant to the authority vested by Deed of Trust dated the 16th day of December, 2005, Byron Conrad and Myrna Conrad, Grantors, to Philip A. Vallandingham and Samuel A. Vallandingham, Trustees, which said Deed of Trust is of record in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Trust Deed Book 2054, beginning at page 726, and the undersigned, Daniel T Yon and Melissa Eakle Leasure, substituted Trustees, by Substitution of Trustees of record in the office of the Clerk of the County Commission of Cabell County in Bonds, Contracts and Leases Book 390 at page 192 having been requested to do so by the Lender, and default having been made under the terms and conditions of said Deed of Trust, and the provisions of said Deed of Trust concerning acceleration having been complied with by the Lender and present holder of the note, said substituted Trustees shall sell at public auction on July 25, 2017 at 11:00 a.m. at the front steps of the courthouse of Cabell County, West Virginia, the following real more particularly described as follows: PARCEL NO. ONE: All those certain lots, tracts, pieces or parcels of land, situate in Barboursville District, Cabell County, West Virginia, bounded and described as follows: BEGINNING at a stake at the foot of hill on the East side of Mason County Road, near and North of Seven Mile Road and six and one-half (61/2) feet back of the concrete curb to brick road and witness by a cross cut on top of said curb, which bears S. 36 35' West, 7 1/2 feet: Thence up and with the East line of said Mason County Turnpike, and remaining 61/2 feet back of said curb line, N. 29 25' West, 128 feet to a point; Thence N. 27 West, 25 feet to a point; Thence N. 19 27' West, 50 feet to a point; Thence N. 9 West, 45 feet to a point; Thence N. 1 50' East, 50 feet to a point; Thence N. 6 20' East, 70 feet to a point; Thence N. 9 05' East, 80 feet to a point or stake; 61/2 feet back of said curb witnessed by a cross cut on top of said curb, which bears N. 81 10 West, 6.8 feet; Thence leaving said road and running up the hill S. 81 10' E, 297 feet to a stake in the exterior line of an 11.35 acre tract on a point, witnessed by a locust corner to said tract, bearing N. 12 30' East, 155 feet; Thence down the point, S. 12 30' West, 124 feet to a corner of a fence post; Thence down the side of point, S. 35 35' West, 336.5 feet to the point of BEGINNING, and containing two (2) acres, be the same more or less. PARCEL NO. TWO: All that certain section or parcel of the right of way of Old State Route 2 along Project 2032-C at Big Seven Mile, Cabell County West Virginia, bounded and described as follows: BEGINNING at the point of intersection of the west right of way line of the Old Ohio River Road with the east right of way line of Project 2032-C Big Seven Mile Creek and Approaches, in Cabell County, said point being 40 feet right and east of about center line Station POC 275-50, thence with east right of way line of Project 2032-C, which curves to the east a distance of 65 feet, more or less, to the intersection of the east right of way line of Project 2032-C and the east right of way line of the old Ohio River Road; thence with said right of way line of the old Ohio River Road in a south-easterly direction a distance of 195 feet, more or less, to the point of intersection of the right of way line of the old Ohio River Road to the property line of C.A. Dashner; thence in a southwesterly direction, crossing the old Ohio River Road, a distance of 35 feet, more or less, to the westerly right of way line of the old Ohio River Road; thence with the west right of way line of the old Ohio River Road in a northwesterly direction, a distance of 140 feet, more or less, to the point of BEGINNING, containing 0.20 acre, more or less. PARCEL NO. THREE: All that certain parcel of land situated in Barboursville District, Cabell County, West Virginia, and being more particularly described as follows: BEGINNING at an iron pin set in the north line of Secondary Route #11, otherwise known as Big Seven Mile Road, said iron pin being in the outside line of Paul Baumgardner; thence, from said beginning, with said Baumgardner line, N. 25 26' W. 51.62 feet to the westernmost corner of said Baumgardner; thence, continuing with said Baumgardner line, N. 39 14' E. 38.50 feet to an iron pin set at the westernmost corner to parcels #1 and #2 of the property of Charles Cupp; thence, N. 39 14' E. 336.50 feet to an iron pin (set); thence, leaving said Baumgardner line, and severing the lands of same, S. 20 16' W. 348.48 feet to a 7 inch locust; thence, S. 20 16' W. 25.81 feet to a point in the north line of Secondary Route #11; thence, with said Route, curving to the left (radius = 574.75 feet), a distance of 86.55 feet to the BEGINNING, containing 24,551.8 square feet. TERMS OF SALE: Ten percent (10%) of total bid amount cash in hand on day of sale. Remainder due within 30 days from date of Trustee Sale. Payment for unpaid real estate taxes to be assumed by the purchaser. Subject to any and all assessments and taxes against said property, and all prior liens and encumbrances of any nature whatsoever. The purchaser shall be responsible for the payment of the transfer taxes imposed by Article 2 of Chapter 11 of the West Virginia Code. Any sale hereunder may be adjourned from time to time without any notice other than the oral proclamation at the time and place appointed for this sale or by posting of a notice of same. Subject to the right of the Internal Revenue Service to redeem the property as provided by Section 7425 of the Internal Revenue Code, as amended. Any sale may be conducted or adjourned by the designated agents or attorney of the Trustee. The undersigned is fully vested with the authority to sell said property as substituted Trustee.
