TRUSTEE'S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated April 16, 2013,, and duly recorded in the Office of the Clerk of the County Commission of Logan County, West Virginia, in Document No. 001410390020, in Book No. 602, at Page 838, Michael J. Ferrell and Laura L. Ferrell did convey unto Richard A. Pill, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated March 22, 2017, and recorded in the aforesaid Clerk's office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Branch Banking and Trust Company to foreclose thereunder, will offer for sale at public auction at the front door of the Logan County Courthouse in Logan, West Virginia, on September 11, 2017 at 1:00 PM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Guyan District, Logan County, West Virginia, and more particularly described as follows: The SURFACE ONLY of all of those certain lots, pieces, or parcels of real estate, together with all and singular the improvements thereon and the appurtenances thereunto belonging or in any manner thereunto appertaining, situate, lying and being in Guyan District, Logan County, West Virginia, more particularly described as follows FIRST PARCEL ALL OF LOT NO 301, in the Hidden Valley Subdivision, situate on Toney Branch of Guyandotte River in Guyan District, Logan County, West Virginia, as shown upon a map or plat entitled, "Plat Showing Location of Lots No 301, 302, 303 & 304 Hidden Valley Development Corp Subdivision, Airport Road Guyan District, Logan Co , West Virginia 1" = 50' -Date- 01.23.81" which map or plat is of record in the Office of the Clerk of the County Commission of Logan County, West Virginia, in Map Book No 10, at page 21, SECOND PARCEL Beginning at a point on the northeastern corner of Lot No 301, which point is on the common boundary line between Lot No 301 and 302 as shown and described upon a map or plat of record in Map Record Book No 10, at page 21, thence N 82 03 E. 20 feet to a point on the boundary line of Lot No 302, S 3 07' E. 125.00 feet to a point, thence S. 82 3 W. 20 feet to a point on the common boundary line between Lot No 301 and Lot No 302 to a point, and also being the place of beginning, and being a part of Lot No 302. Together with the right to be served by the sewage treatment plant and facilities as is provided for in Declarations hereinafter mentioned, and the parties of the second part shall also have those responsibilities that are set out in such Declaration. Subject to all the exceptions, reservations, covenants, terms, restrictions, conditions and provisions contained in that certain "DECLARATION AND DEDICATION OF PROTECTIVE AND RESTRICTIVE COVENANTS RELATING TO THE VARIOUS 'HIDDEN VALLEY' SUBDIVISION, GUYAN DISTRICT, LOGAN COUNTY, WEST VIRGINIA", dated January 1, 1985, recorded in the aforesaid Clerk's Office in Deed Book No 438, at page 329. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 301 Hidden Valley, Chapmanville, WV 25508. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk's Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in "AS IS" condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $9000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
